Article 1 – Prices
1.1 – The prices of our products are indicated in euros all taxes included (VAT) excluding participation in processing and shipping costs.
1.2 – Omaké Books reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of your order validation.
1.3 - Products remain the property of Omaké Books until full payment has been received.
1.4 – The Omaké sales site (https://omakebooks.com) is not intended to sell to professionals. To obtain the advantages related to your profession, only a contact by e-mail or telephone will give the right to negotiations.

Contractual information is presented in French language and will be the subject of a confirmation taking again this contractual information at the latest at the time of your validation of order.
Article 3 – Validation
You must read these General Terms and Conditions of Sale before placing your order. The validation of your order therefore implies acceptance of these General Terms and Conditions of Sale.
Unless clearly stated otherwise, the data recorded by Omaké Books constitutes proof of all transactions between Omaké and its customers.
Article 4 – Availability
Our product offers are valid as long as they are visible on the site, within the limit of available stocks, excluding promotional operations mentioned as such on the sites. In the event of unavailability of a product after placing your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
Article 5 – Delivery
5.1 – General
Orders are processed and dispatched within 48 working hours at the latest by our logistics department. They are delivered to the delivery address you indicated during the ordering process. The deadline for delivery, for metropolitan France, can take up to a week and corresponds to
• to the shipping time indicated above
• the processing and delivery time by post.
5.2 - Grouped orders and "pre-orders"
When you order several products at the same time and these have different marketing dates (in particular "pre-orders"), the delivery date of the order is based on the last item to come. All shipments are therefore grouped together in a single click. The order processing time remains 48 working hours, upon receipt of the last item in the premises of our dispatch department. However, Omaké Books reserves the right to split shipments. The participation in the processing and shipping costs will be charged for one shipment only.
5.3 - Shipping delays
In the event of a delay in dispatch, an e-mail will be sent to you to inform you of any possible consequences on the delivery deadline that has been indicated to you. In the event of a delay in delivery, we will propose a new delivery date by e-mail. In any event, in accordance with the legal provisions, in the event of a delay in delivery of more than 7 days, you have the possibility of cancelling your order within 60 working days. In this case, if you have received the product, after your cancellation, we will proceed to refund the product and the outward expenses, upon receipt of the product by us, complete and in its original condition.
We also invite you to contact Customer Service for any questions or problems. In the case of payment by credit or private card and split deliveries, only the products shipped are debited.
5.4 - Delivery when paying by cheque and bank transfer
In the case of payment by cheque or bank transfer, the order will be dispatched after confirmation of receipt of the cheque or transfer by us.
5.5 – Reservations
You must notify the carrier and Omaké Books of any reservations about the product delivered (for example: damaged package, already opened...). According to the cases defined in article 9 below, you can benefit from the conditions of exchange and reimbursement provided for in this article.
Article 6 – Payment
The payment of your purchases is made:
• either by credit card
• either by Paypal
• or by bank cheque
In the case of payment by cheque, the cheque must be issued by a bank domiciled in metropolitan France or Monaco.
The cheque is cashed on receipt of the cheque.
Article 7 – Security
Our site is subject to a security system..
We have adopted the Paypal and Payplug procedures, which are reliable and now recognised worldwide, to protect all sensitive data related to payment methods as effectively as possible.
Article 8 – Satisfied or refunded 7 days - Right of withdrawal or exchange
8.1 - In accordance with the legal provisions in force, you have a period of 7 days from receipt of your products to exercise your right of retraction with Omaké Books without having to justify your reasons or pay any penalty.
Please note: The return costs are the responsibility of the customer and will under no circumstances be reimbursed.
In the event of exercising the right of retraction within the above-mentioned period, only the price of the product(s) purchased will be refunded.
8.2 - Exchanges (cause: faulty, damaged equipment): you must return the product to be exchanged and may only claim an exchange on a similar product.
The return costs remain at your expense. The cost of returning a new exchanged product remains at the expense of Omaké Books.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be re-sold as new, and accompanied by a copy of the purchase confirmation sent by e-mail after your order, as well as a written request for retraction.
8.3 - Products on sale are neither taken back, nor exchanged, nor reimbursed.
8.4 – Return address

8.5 - Partial reimbursement: partial reimbursement is not possible. It is full, after the return of the defective products if an exchange is not possible.
Article 9 – Conformity of products
We undertake to reimburse you or to exchange you any products that are defective, damaged or do not correspond to your order. In this case, we would be grateful if you would state this in detail in writing on our online after-sales service page and return the product(s) to us. Omaké Books will, at your choice, exchange or refund the product(s) (see Article 8 for refund conditions). In any case, you benefit from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force.
The stipulations of this article do not prevent you from benefiting from the right of withdrawal provided for in Article 8.
Article 10 – Refunds
Refunds of products in the hypotheses referred to in articles 8 and 9 will be made as soon as possible and at the latest within 30 days following the date on which the right was exercised. Reimbursement will be made on the proposal of Omaké Books by crediting the customer's bank account or by bank cheque sent in the name of the customer who placed the order and to the billing address. The customer may opt for another method of reimbursement than the one proposed (reimbursement in cash is however impossible). No cash on delivery will be accepted for any reason whatsoever.

As such, and in accordance with the provisions of the intellectual property code, only private use subject to different or even more restrictive provisions of the intellectual property code is authorised. Any total or partial reproduction or representation of the Omaké Books sites or of all or part of the elements found on the Omaké Books sites is strictly forbidden.
Article 13 – Liability
The products on offer comply with current French legislation. Omaké Books cannot be held responsible in the event of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with local authorities the possibilities of importing or using the products or services you plan to order.

We invite you to refer to the description of each product to find out its precise characteristics; and in case of doubt or if you would like further information, please do not hesitate to contact us. Our products have performances compatible with professional use. However, Omaké Books may be held liable for any damage whatsoever resulting from a third party professional activity or its products.
Article 14 – Applicable law - Disputes
This contract is subject to French law.
The language of this contract is the French language.
In the event of a dispute, the French courts will have sole jurisdiction.

The information and data concerning you are necessary for the management of your order and for our commercial relations. They may be transmitted to companies that contribute to these relations such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you.
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose any personal data concerning you.
